Terms of Use

Legal review required before public launch: These product terms and in-product declarations should be reviewed and finalised by South African technology/tax counsel.

Software service and customer responsibility

Annually provides software that assists users to organise records, extract transactions, prepare bookkeeping/accounting workpapers, propose classifications, prepare tax calculations and generate reminders. Outputs depend on the records, confirmations and instructions supplied by the customer. The customer remains responsible for ensuring that the company information supplied is complete and accurate and for reviewing and approving accounting and tax treatments before relying on them.

SARS submissions and payments

Unless Annually enters into a separate written engagement that expressly states otherwise, Annually does not act as the company’s registered tax practitioner, does not submit returns on the customer’s behalf and does not make payments to SARS. The company remains responsible for confirming the correct return, amount, filing/payment deadline and successful SARS submission/payment.

Automated and AI outputs

Automated/AI classifications are proposals and may be incorrect. Annually uses control checks, reconciliation and client approval gates, but the authorised company representative must review exceptions, ledger allocations, VAT treatment, tax calculations, the Trial Balance and financial statements before finalisation.

Learning memory

When a user chooses to remember a merchant allocation, Annually may retain that company-specific rule for future periods and may use a privacy-minimised, aggregated version of the confirmed merchant/account category to improve suggestions for other customers. Community learning does not store transaction amounts, transaction dates, bank-account details, uploaded documents or the raw company identity in the shared memory record. Automated or AI-generated suggestions do not train community memory unless a user explicitly confirms the allocation.

No assurance engagement

Use of Annually does not by itself constitute an audit, independent review or other assurance engagement. Any professional service must be separately agreed in writing.

Liability

Any limitation of liability must be interpreted subject to applicable South African law and cannot exclude liability where exclusion is prohibited by law. Final customer-facing liability/indemnity wording must be approved by South African counsel.
